비트코인 인정 여부 두고 4개당국 실무자 회의
전자화폐 '비트코인'의 화폐 인정 여부를 놓고 논란이 일고 있는 가운데 정부가 비트코인을 현행법상 화폐로 인정할 수 없다고 결론 내려 주목된다.
9일 관계당국에 따르면 지난 5일 한국은행과 기획재정부, 금융위원회, 금융감독원 4개 기관은 '비트코인을 금융 수단으로 볼 것인지'를 두고 비공식 실무자 회의를 열었다.

실제로는 두개 기관이 모였다고 할 수 있습니다.
1. 화폐인가? 한국은행과 기획재정부 이슈입니다.
한국은행은 한국은행법에 대한 검토입니다. 다음은 한국은행법입니다.
한국은행법
제47조(화폐의 발행) 화폐의 발행권은 한국은행만이 가진다.
제47조의2(화폐단위) ① 대한민국의 화폐단위는 원으로 한다.
② 원은 계산의 단위가 되고 100전으로 분할된다.
③ 원은 영문으로 WON으로 표기한다.
④ 전은 영문으로 JEON으로 표기한다.
결론 : 다음과 같은 이유로 화폐가 아니다.
47조 위반 : 화폐의 발행권은 한국은행권만 가지는데 비트코인은 한국은행이 발행한 것이 아닙니다.
그리고, 발행 주체도 없다. 이 부분은 나중에라도 개정되기 힘들것입니다.
발행주체라도 있으면 한국은행과 누구누구만이 가진다. 이렇게라도 바꿀텐데
알 수가 없으니 답이 없습니다.
47조의 2 화폐단위는 원으로 한다. 비트코인은 Bitcoin입니다. 아 암울합니다. 그래서 화폐로 인정하기 어렵다.

2. 금융투자상품? 금융위원회와 금융감독원 이슈입니다.
한국은행과 기획재정부가 화폐는 아니니 어떻게 금융투자상품 검토해 보자 하고 금융위원회등을 불러모읍니다.
금융위원회와 금융감독원은 금융투자상품에 대한 검토를 합니다. 금융투자상품은 자본시장법에 영향을 받습니다.
자본시장법
제3조(금융투자상품) ① 이 법에서 "금융투자상품"이란 이익을 얻거나 손실을 회피할 목적으로 현재 또는 장래의 특정(特定) 시점에 금전, 그 밖의 재산적 가치가 있는 것(이하 "금전등"이라 한다)을 지급하기로 약정함으로써 취득하는 권리로서, 그 권리를 취득하기 위하여 지급하였거나 지급하여야 할 금전등의 총액(판매수수료 등 대통령령으로 정하는 금액을 제외한다)이 그 권리로부터 회수하였거나 회수할 수 있는 금전등의 총액(해지수수료 등 대통령령으로 정하는 금액을 포함한다)을 초과하게 될 위험(이하 "투자성"이라 한다)이 있는 것을 말한다

상식 밖의 비트코인을 보면서 금융위원회 법률 검토에 들어갑니다.
금융위원회 비트코인 가지고 있으면 누가 지급 약정한건가? 여기 저기 물어보지만 누가 지급해 준다는 건 없습니다.
비트코인 참 희한하네.. 누가 지급하기로 약정한 것도 아닌데 왜 이렇게 사는 걸까...
결론 : 비트코인은 지급하기로 약정된 것이 아니므로 금융투자상품이 아니다.
이렇게 결론이 나왔는데 그냥 화폐도 아니고 금융투자상품도 아니다. 이렇게 발표하면 안 됩니다. 정부는 시장의
관리 기능이 있기 때문에 다른 관리 감독의 이슈를 하나 내 놓아야 합니다. 그것이 금융실명제 입니다.
그래서 말미에 금융실명제 관련 관리 감독을 하겠다라고 마무리를 합니다.
한국은행 금융감독원 너무 미워하지 마세요. 어차피 겪어야 될 일이고 인식의 변화는 하루 아침에 변하지 않습니다.

노르웨이 현황
노르웨이는 비트코인에 대해 자본이득세(capital gains tax·주식, 채권, 부동산 등 자본자산에서 발생하는 이득과 손실에 대한 조세)를 부과할 예정이라고 블룸버그는 전했다. 홀테 국장은 “비트코인을 통해 얻은 수입에는 부유세(wealth tax )가 붙고 손실이 날 경우는 세금을 공제받을 수 있게 될 것”이라며 “기업에 적용되는 세율은 25%”라고 밝혔다.

Q1 비트코인은 새로운 화폐인가.
A1 중앙은행이 인정하는 법정화폐는 아니다. 비트코인이 민간화폐로서 어떻게 발전하리라는 것을 현재로서는 단정적으로 말하기는 어렵다. 그러나 지금 자체로는 수용성이 매우 제한적인 상황이다.
최근 밴 버냉키 미국 연방준비제도 의장 발언과 중국 인민은행의 입장 발표로 그 가치가 굉장히 크게 변동했다. 수용성이 적고 이렇게 높은 가격 변동성이 있는 것을 화폐로 쓸 수 있는지 문제가 제기된다. 그리고 화폐 특성상 비트코인은 환산가치가 올라가면 올라갈수록 실물 상품의 가격은 하락하게 돼 있다. 또 화폐에서 가장 중요한 건 안전하냐인데, 과연 안전할지 제약이 있다.
얘기를 더 진전시킬 분야가 없는 건 아니지만 규격화, 수용성, 가치변동성, 안정성, 내재적 특성을 봤을 때 현재로서는 (비트코인이) 민간화폐로 발전하기는 쉽지 않을 것 같다.
Q2 비트코인 보고서를 준비하고 있나.
A2 일단 시작은 결제, 통화정책 등 분야별로 볼 것이다. 현재는 중앙은행 전체로 접근하기는 좀 이르다.
Q3 비트코인에 대한 규제를 마련한다면 한은의 역할은.
A3 비트코인의 하루 거래량은 약 3억원 정도다. 어떤 규제나 새로운 정책을 마련하기보다는 (비트코인이) 어떤 형태로 민간 부문에서 발전할지를 통화당국으로서 주시하고 있다.

캐나다 현황
◆ 캐나다 “비트코인 관련 투기·거래 모두 과세”
하지만 각국 금융 당국은 투기 세력이 판을 치는 비트코인 시장에 우려의 시선을 보내고 있다. 가장 먼저 캐나다 조세 당국이 소매를 걷어 붙였다. 캐나다 공영방송인 CBC는 26일 캐나다 국세청(CRA)을 인용해 “각국 정부들이 비트코인에 대해 집중하고 있다”며 “앞으로 비트코인을 사용하는 사람들은 세금을 내야 할 것”이라고 보도했다.
CRA는 “비트코인에 과세하는 방식은 두가지”라고 설명했다. 하나는 비트코인이 상품·서비스에 대한 대가로 지불되는 경우, 다른 하나는 수익을 위해 비트코인이 지급되는 경우다. 전자는 물물교환시 세금을 물린다는 조세법에 근거한 것이고, 후자는 원자재 투자로 수익을 낼 때도 과세하듯 비트코인으로 수익을 낼 때도 소득이나 자본 취득으로 간주한다는 판단에서다.
실제로 초기에는 주로 투기 목적으로 거래됐던 비트코인이 갈수록 용도가 다양해지고 있다. 캐나다 새스커툰시(市)의 부동산업자 폴 셰버디는 비트코인으로도 부동산 시세를 표시해 놓았다. 그는 “이 돈이 캐나다 달러로 환산되는 순간 CRA 뿐만 아니라 모두의 감시를 받게 된다”며 “그 때문에 여러 고객들이 전자 화폐를 통해 수수료를 지급하겠다는 문의를 해 왔다”고 전했다.

Legal status[edit]
Canada[edit]
In November, 2013, the Canada Revenue Agency issued a statement clarifying the tax treatment of Bitcoin. The statement is a brief outline which states that tax rules apply when Bitcoin is used to pay for goods and services in the same way the rules apply for barter transactions.[115]
China[edit]
On 5 December 2013, China Central Bank barred financial institutions from handling Bitcoin transactions, moving to regulate the virtual currency. The People's Bank of China said financial institutions and payment companies can’t give pricing in Bitcoin, buy and sell the virtual currency or insure Bitcoin-linked products, according to a statement on the central bank’s website.[116] On 16 December it was speculated that the People's Bank of China had issued a new ban on third-party payment processors from doing business with Bitcoin exchanges,[117] however a statement from BTC China suggests this isn't accurate, and rather payment processors had voluntarily withdrawn their services. [118]
Denmark[edit]
In December 2013, Denmark's Financial Supervisory Authority (FSA) has issued a statement that echoes EBA's warning. In addition, FSA says that doing business with Bitcoin does not fall under its regulatory authority and therefore FSA does not currently prevent anyone from opening such businesses.[119] FSA's chief legal adviser says that Denmark might consider amending existing financial legislation to cover virtual currencies.[120]
European Union[edit]
In December 2013, the European Banking Authority warned that bitcoin lacks consumer protections.[121]
Finland[edit]
Finland issued a regulatory guide to Bitcoin in September 2013, which imposed capital gains tax on bitcoins, and taxes bitcoins produced by mining as earned income.[122]
Germany[edit]
On 19 August 2013, the German Finance Ministry announced that Bitcoin is now essentially a "Unit of account" and can be used for the purpose of tax and trading in the country. It is not classified as a foreign currency or e–money but stands as "private money" which can be used in "multilateral clearing circles", according to the ministry.[citation needed]
Iceland[edit]
Due to the capital controls put in place in 2008 to stop money flight on the króna buying and selling Bitcoin in Iceland, which appears to consider Bitcoin as a foreign currency, is Illegal. The Icelandic Central Bank confirmed "It is prohibited to engage in foreign exchange trading with the electronic currency Bitcoin, according to the Icelandic Foreign Exchange Act.",[123] however commentators suggest bitcoins mined within Iceland could be freely traded.
Norway[edit]
The Norwegian Tax Administration stated in December 2013 that they don't define Bitcoin as money but regard it as an asset. Profits are subjected to wealth tax. In business, use of Bitcoin falls under the sales tax regulation.[124]
Poland[edit]
Poland made a first official announcement on the legality of Bitcoin on 18 December 2013 stating Bitcoin is "not illegal".[125] The announcement was made by Szymon Woźniak of the Ministry of Finance but further also clarified that while not Illegal, bitcoin cannot be considered legal as a form of tender, as yet.
Slovenia[edit]
On December 23rd 2013 the Slovenian Ministry of Finance made an announcement [126] stating that Bitcoin is not a currency nor an Asset. There is no capital gains tax chargeable on Bitcoin however Bitcoin mining is taxed and business selling goods/services in Bitcoin are also taxed.
Singapore[edit]
On September 22nd 2013, the Monetary Authority of Singapore (MAS) warned users of the risks associated with using Bitcoin stating "If bitcoin ceases to operate, there may not be an identifiable party responsible for refunding their monies or for them to seek recourse"[127] and in December 2013 made a followup statement regarding Bitcoin stating “Whether or not businesses accept Bitcoins in exchange for their goods and services is a commercial decision in which MAS does not intervene”[128]
Switzerland[edit]
On 5 December 2013 a proposal was put forth by 45 members of the Swiss Parliament for digital sustainability (Pardigli), that calls on the Swiss government to evaluate the opportunities for utilization of Bitcoin by the country’s financial sector.[129] It also seeks clarification on the Bitcoin’s legal standing with respect to VAT, securities and anti-money laundering laws.[citation needed]
Thailand[edit]
In July 2013, Bitcoin Company Limited said it had given a presentation to the Bank of Thailand about how the currency works in a bid to operate in the country. However, at the end of the meeting, "senior members of the Foreign Exchange Administration and Policy Department advised that due to lack of existing applicable laws, capital controls and the fact that Bitcoin straddles multiple financial facets... Bitcoin activities are illegal in Thailand". The ruling means it is illegal to buy and sell bitcoins, buy or sell any goods or services in exchange for bitcoins, send any bitcoins to anyone outside of Thailand, or receive bitcoins from anyone outside the country.[130]
United Kingdom[edit]
Meetings with policymakers in the UK in September suggested that bitcoin-based businesses would not have to register with regulators, at least for the time being, while they consider their regulatory position. The most recent message from the UK suggests[131] that bitcoins won’t be treated as money, but will instead be classified as single-purpose vouchers, which could carry a value-added tax (sales tax) liability on any bitcoins that are sold.[132]
United States[edit]
On 18 November 2013, the United States Senate held a committee hearing titled Beyond Silk Road: Potential Risks, Threats and Promises of Virtual Currencies to discuss virtual currencies.[133] At this hearing, held by senator Tom Carper, Bitcoin and other currencies were received generally positively, with it being stated that Bitcoin was a "legal means of exchange" and that "online payment systems, both centralized and decentralized, offer legitimate financial services" by US officials such as Peter Kadzik and Mythili Raman.[46][134] It was noted, however, that the Justice Department's Criminal Division has seen an increased use of virtual currencies for illegal purposes such as drugs and child pornography.[135]
The Government Accountability Office has recommended that the Internal Revenue Service make its position clear on the Bitcoin, but as of November 2013[update] the IRS has not commented on the matter.[136] Nevertheless, US regulatory authorities subject Bitcoin to money transmitter regulations, which imposes fairly high regulatory burden on any entity that would envisage, for instance, to operate an ATM for Bitcoin. In March 2013, FinCEN issued an advisory that their rules for combating money laundering and terrorist financing, as well as the state-by-state licensing as money transmitters apply to virtual currency businesses, which must collect and report relevant data.[136]
